(“we”, “us”, “our”) 

Dear Guest,

It is a condition of entry to Château de Gudanes (“château”) that you read and agree to comply with the terms of this letter which sets out our policies concerning the terms and conditions of your private event, the taking of photographs and your safety. 

By placing a reservation as an organiser of a private event, or attending a private event as a guest, you confirm that you have read and understood this agreement prior to accepting it, and are aware that by accepting this agreement you are waiving certain legal rights which you or your heirs, next of kin, executors, administrators, assigns and representatives may have against Château de Gudanes, SCI Les Torrents d’Aston, its management and its team.


Terms & Conditions

1. Personal Details: In order for us to process your reservation, you are required to provide us with your full name, dietary requirements and any relevant pre-existing health conditions.

2. Deposit: The organiser of the private event (or guest if paying separately) is required to pay Château de Gudanes a deposit of 30% of the total, per person, to confirm your reservation. The deposit is non-refundable, except in the case that the event is cancelled by the château. Any reimbursements will need to be requested directly through your travel insurance provider.

3. Remaining Balance: The organiser of the private event (or guest if paying separately) is required to pay the full balance to Château de Gudanes on or before 60 days prior to the start date of your private event. Private events booked within 60 days of the event date must be paid in full upon placing your reservation. The final balance is non-refundable, except in the case that the event is cancelled by the château. Any reimbursements will need to be requested directly through your travel insurance provider.

4. Minimum Number of Guests: The minimum number of guests for a private event is 10 guests. If the minimum number of guests is not reached by the organiser, Château de Gudanes reserves the right to either cancel the reservation or the organiser can agree to pay the difference between the final guest number and the minimum number of guests required. If the minimum number of guests is not reached and guests are paying separately, Château de Gudanes reserves the right to either cancel the reservation or any number of guests can agree to pay difference between the final guest number and the minimum number to guests required.

5. Late Payment: If the full balance is not received by the due date, Chateau de Gudanes reserves the right to cancel the private event and retain the deposit. 

6. Cancellation by Château de Gudanes: If for some reason, the château needs to cancel your private event, Château de Gudanes will offer a full refund (inclusive of the deposit). We are not responsible for any incidental expenses that you may have incurred as a result of your booking such as visas, insurances, or non-refundable flights.

7. Private Event Inclusions: 

  • Accommodation at Château de Gudanes for up the 15 guests. Room configurations to be organised according to the requests of the organiser. Bathroom facilities are shared and are located on both the ground and first floor,

  • Transport listed for activities and excursions as part of the private event’s schedule. Please ensure that you arrive in Toulouse before the designated pick-up time. Please ensure you arrange your ongoing travels based on our arrival time in Toulouse on the final day. If you arrive or depart at a different time, you will be required to organise and pay for transportation to/from the château at your own cost,

  • All activities and excursions listed on the private event schedule,

  • All meals and house beverages as listed in the schedule. We require that you let us know in advance if you have any allergies. Whilst we will do our best to cater for you, you understand that our kitchen does process allergen items, such as but not limited to, nuts, dairy, gluten and shellfish,

  • Wifi in the bedroom and shared spaces. You acknowledge that wifi may be intermittent due to the location and historical nature of the property,

  • During your stay, you are welcome to use the Salon de Rose. In this room you will discover a selection of board games, card games and puzzles for you to enjoy at your leisure. You agree to be respectful of other guests also using this shared space,

  • In the warmer months you may use the swimming pool and tennis court. Tennis rackets and balls are provided for both tennis and pickleball enthusiasts.

8. Private Event Exclusions:

  • Flights and associated fees to and from Toulouse,

  • Travel and medical insurances,

  • Spending money.

9. Change of Itinerary, Errors & Omissions: While we endeavour to operate all private events as described, we reserve the right to alter the schedule without notice. Although we have made a concerted attempt to verify the accuracy of statements made in our activity schedules, including our website and itineraries, we cannot be held responsible for any error, omission or unintentional misrepresentation that may occur. The final itinerary is subject to change. 

10. Insurance: Travel insurance is compulsory for all private event organisers and participants. Your travel insurance must provide cover against cancellation, personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the heads of cover. We require you to purchase insurance at the time of booking, and that it covers cancellation, curtailment, personal liability and loss of luggage and personal effects.

11. Damage Liability: Guests are responsible for any damage caused to the property or its contents. 

12. Smoking Policy: Smoking is not permitted inside the building or anywhere on the grounds. 

13. Pet Policy: Pets are not permitted. 

14. Security Policy: The front gates and doors shall be locked at 23:00 h / 11:00 pm each evening to ensure the safety and security of the property and guests. 

15. Behaviour Policy: You agree and understand that Château de Gudanes is a private residence with a Class I Historical Monument status. As such, you agree to treat the building, its contents, its resident family and pets, and other guests with care and respect.


Photography & Filming

16. You may take photographs and film of the château and the château’s grounds during your stay. You are permitted to take photos for your personal use only. Personal use includes uploading the photographs onto your social media sites (strictly Facebook and Instagram only) provided that you and/or others do not make any financial or material gain from the photographs. You are not permitted to sell, license or use the photographs for any other purpose. You are not permitted to upload photographs to any social media accounts or websites of a commercial nature. Photographs taken by you that are used by the château will not be credited. 

17. The stables and residences located at the entrance to the château do not form part of the château’s grounds. We are unable therefore to grant you permission to take photographs of these buildings. 

18. Photography and filming for the purposes of this letter agreement, includes recording images on any medium including without limitation on mobile phones, iPads and other electronic devices. 

19. Permission must be sought from anyone that you wish to photograph within the grounds of the château including our team members, contractors, consultants and members of the public. 


Safety

20. The château is undergoing extensive and ongoing restoration work. You acknowledge that parts of the château and its grounds may be hazardous and dangerous. You further acknowledge that you are entering the château and its grounds voluntarily and at your own risk. You are responsible for your own safety. You must exercise care and caution and are recommended to wear closed in shoes at all times. 

21. You acknowledge that the château’s facilities are limited in keeping with our philosophy of experiencing an 18th century château. Some salons and common spaces in the château do not have electricity. It is recommended for you to carry a torch (flashlight) with you when it is dark. You agree to act in a responsible manner around candles and ensure that open flames are not left unattended and that candles are placed in a safe place at all times. 

22. You acknowledge that your personal belongings are not secure and that it is your responsibility to ensure that you keep valuables safe. We cannot be held responsible for any loss or damage that occurs to your belongings. 


Release & Indemnity

23. In consideration of you being permitted to enter the château and its grounds for your own purposes you hereby assume all risk of accident and all risk of personal injury (including death) to yourself and to your personal property, sustained whilst you are in the château and its grounds and you and your heirs, executors, administrators, personal representatives and assigns hereby release us and our directors, officers, and employees from any and all liability whatsoever for any loss, personal injury (including death) or property damage which you may suffer whilst in the château and its grounds. 

24. You hereby agree to hold harmless and indemnify us, our directors, officers, employees, licensees, agents, assigns and successors against any and all claims, actions, proceedings, demands, liability, costs, losses, damages and expenses resulting from or by reason of any claim arising from a breach of any of your representations, agreements and undertakings made by you in this letter agreement. 

25. Château de Gudanes reserves the right, at its sole discretion, to take appropriate action should the terms of this agreement be breached.  You may be asked to leave the property without notice. Château de Gudanes will not refund payment or accept any consequential liability damages or loss.

26. This agreement shall be governed by, and construed in accordance with, the laws of England and Wales, whose courts shall be the courts of exclusive jurisdiction.
